• Security: You are responsible for safeguarding the password or API keys that You use to access the Service and for any activities or actions under Your credentials.
• Unauthorized Access: You agree not to disclose Your password or API keys to any unauthorized third party. You must notify Us immediately upon becoming aware of any breach of security or unauthorized use of Your account.
• Age Requirement: You must be at least 18 years of age or the legal age of majority in Your jurisdiction to create an account and use the Service.

2. Vehicle History Reports and Data Usage

GlobalVIN provides multi-source vehicle history aggregation, VIN lookup, and automotive data API services.

• Data Sources: Vehicle data and reports provided through the Service are aggregated from multiple third-party databases, government registries, and auction records.
• Information Accuracy: While We strive to provide the most up-to-date and complete vehicle records, We do not guarantee that every report will capture every historic record or event in a vehicle's lifecycle.
• Permitted Use: You may use reports and data obtained from the Service strictly for legitimate automotive verification, dealership inventory audit, buying decisions, fleet management, or integrated API software application needs.

3. API Access and Developer Guidelines

For users accessing GlobalVIN via our Developer API endpoints:

• Rate Limits & Fair Use: You agree to abide by API rate limits and fair usage policies outlined in our API documentation. Excessive or abusive request bursts designed to destabilize the Service are strictly prohibited.
• Prohibition on Reselling Raw Data: Unless explicitly agreed under a White-Label or Enterprise partnership agreement, You may not scrape, dump, or resell unmodified raw API responses to third-party data brokers.
• API Key Confidentiality: API keys are issued specifically for Your organization and must not be exposed in client-side public repositories or front-end code.

4. Credits, Billing, and Refunds

Certain features of the Service operate on a credit purchase or subscription basis:

• Credits: Purchasing vehicle report credits or API lookup balance grants You a license to consume reports on-demand.
• Payment Processing: All payments are processed securely through authorized third-party payment providers (e.g. Stripe, PayPal).
• Refund Policy: Due to the instant delivery nature of digital vehicle data, consumed report credits are non-refundable once data has been fetched from underlying sources, except where required by applicable law or verified system errors.

5. Intellectual Property

The Service and its original content, branding, dynamic report layouts, features, and functionality are and will remain the exclusive property of GlobalVIN and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and brand identity may not be used in connection with any product or service without the prior written consent of GlobalVIN.

6. Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the Service for any unlawful or fraudulent vehicle identity activity (e.g. VIN cloning).
• Attempting to probe, scan, or test the vulnerability of Our systems or network.
• Bypassing or circumventing authentication or security measures.
• Interfering with, or attempting to interfere with, the proper working of the Service.

7. Limitation of Liability

In no event shall GlobalVIN, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any vehicle purchase or sale decision made based on third-party vehicle history data.

8. Disclaimer of Warranties

Your use of the Service is at Your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

9. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

10. Changes to Terms

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. We will provide notice of material changes by updating the "Last updated" date at the top of this page or sending an email notification to registered accounts.
